What We Challenge

⚖️

PBT / Intoximeter / Blood Test Results

Two tests are typically administered to individuals suspected of driving under the influence. They are sometimes collectively referred to as the breathalyzer test or a blood test. The police administer both the preliminary breath test and the subsequent post-arrest breath or blood test for distinct and separate purposes. We identify when the results should be invalidated.

🔍

Field Sobriety Tests

Field sobriety tests are what the police use as evidence against you in court. Taking these tests is voluntary in Maryland, and you cannot be penalized in court for refusing them. When administered, they must be conducted properly. We identify when they are not and work to get the results invalidated.

📋

Procedural Errors

From the traffic stop to the administration of the blood and/or breath alcohol test, we review your case in detail to ensure the police complied with all procedural obligations. If they failed to follow proper procedures, evidence may be suppressed, results invalidated, and the State's case against you dismissed.

🚔

Reasonable Suspicion

Police don't need much justification to pull you over — only specific, articulable facts suggesting something criminal is occurring. Speeding, swerving between lanes, or a broken taillight is usually enough. But if they had no valid reason to stop you, the stop can often be suppressed and the State's case crumbles.

📹

Dash & Body Cam Footage

We often challenge the officer's narrative using dash and body cam footage from the scene. Whether the footage is favorable or not, if body cam was used, we see to it that it is recovered and reviewed. In the hands of a skilled attorney, this footage is often valuable material for your defense.

10
Days

Most people don't realize it, but after you're charged with a DUI in Maryland, the clock starts ticking on your driver's license. Drivers charged with a DUI are typically given a temporary license valid for 45 days. If you fail to request an MVA hearing to challenge the suspension within 10 days of your DUI stop, your license will likely be automatically suspended on the 46th day — regardless of the outcome of your criminal trial. We help clients navigate the MVA maze and protect your license.
